1. Eligibility
You must be at least 13 years old, or 16 in the EEA or UK, to use REPCIR. You are responsible for keeping account information accurate and for activity under your account.
2. Medical disclaimer
REPCIR is not a medical device or healthcare provider. AI coaching, workouts, readiness summaries, and recommendations are for general fitness and informational purposes only. They are not medical advice, diagnosis, or treatment and do not replace a physician, physical therapist, or other qualified professional.
3. Assumption of risk
Physical exercise carries inherent risk. You are responsible for training within your ability, using proper form and equipment, and deciding whether a recommendation is appropriate for you.
4. AI coaching
- AI responses are automated and may be inaccurate or incomplete.
- The AI is not a licensed professional and forms no professional relationship.
- You are responsible for the data you give REPCIR and the decisions you make.
5. Your content
You keep ownership of workouts, posts, messages, photos, videos, and other content you create. You grant REPCIR the limited rights needed to host, process, display, and share that content according to your visibility settings.
6. Social features
Circles, messages, comments, posts, and public profiles must be used respectfully. Do not harass, impersonate, threaten, scrape, bypass protections, or upload unlawful, infringing, abusive, or unsafe content. You also agree not to use REPCIR to build a competing product, to train machine-learning models on data you are not authorized to use, or to interfere with or disrupt REPCIR or its infrastructure, and not to misuse the AI to generate harmful, illegal, or abusive content. We may remove content or suspend accounts that violate these rules.
7. Subscriptions and billing
- Paid tiers are billed through Stripe.
- Subscriptions renew automatically at the then-current price until canceled.
- You can cancel anytime; access continues until the end of the paid period and is not prorated, except where required by law.
- Except where required by law, payments are non-refundable. We may, at our discretion, honor refund requests made to support within 14 days of a charge.
- We may change prices; changes apply to the next billing period after reasonable notice.
- Plan features and limits are described in app and may change with notice.
8. Third-party services
REPCIR integrates with third-party providers for authentication, payments, hosting, AI, analytics, error monitoring, email, media storage, and wearable data. Your use of those integrations may be subject to their terms and privacy policies.
9. Disclaimers and limitation of liability
REPCIR is provided "as is" and "as available." To the fullest extent permitted by law, Quiet Victory Labs and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for personal injury arising from training decisions you make using the service. Our total aggregate liability for any claim relating to the service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim or (b) USD 100. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.
10. Indemnification
You agree to indemnify and hold REPCIR harmless from claims, damages, and expenses (including reasonable legal fees) arising from your content, your use of the service, or your violation of these Terms or any law or third-party right.
11. Termination
You may stop using REPCIR and delete your account at any time from app settings. We may suspend or terminate access if you violate these Terms or to protect users, the service, or the public. Sections that by their nature should survive termination, such as content licenses you granted to other users, disclaimers, liability limits, and indemnification, survive.
12. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-laws rules. The parties will try to resolve disputes informally first by contacting legal@repcir.com. Any unresolved dispute will be resolved in the state or federal courts located in Delaware, except where applicable law gives you the right to bring a claim in your local courts. Nothing here limits non-waivable consumer rights you have under local law.
13. Changes
We may update these Terms as REPCIR evolves. We will update the "Last updated" date and, for material changes, provide additional notice. Continued use after changes take effect means you accept the updated Terms.
